The Communications Authority of Kenya (CA) is the regulatory authority for the ICT industry in Kenya with responsibilities in telecommunications, cyber security, e-commerce, broadcasting, multimedia and postal/courier services. CA is also responsible for managing the country’s numbering and frequency spectrum resources, managing and administering the Universal Service Fund (USF) as well as safeguarding the interests of users of ICT services.

The Kenya Information and Communications Act, 1998 (as amended) mandates the Authority to licence and regulate broadcasting services in Kenya.

In furtherance of the responsibility of promoting and facilitating the development of a diverse range of broadcasting services in Kenya in keeping with the public interest as provided for under Section 46A (a) of Act, the Authority has developed a draft licensing framework for Digital Sound Broadcasting (DSB).

Through a public consultation process in FY 2022/23, the Authority adopted a DSB Framework that provides the strategy for the introduction of digital sound broadcasting services in Kenya.

The objective of this current consultation on DSB Licensing Framework is to give stakeholders and the public an opportunity to comment on the proposed licensing framework that is aimed at operationalising the approved DSB Framework.

The proposed licensing framework for DSB is available on the Authority’s website at https://www.ca.go.ke/open-consultations

Stakeholders, including members of the public, agencies dealing with media and broadcast issues, licensees and incorporated bodies are invited to review and submit their specific inputs and views on the proposed licensing framework for DSB.

Written comments on specific proposed requirements and any other requirement shall be sent to the address indicated below or via email address DSBlicensing2023@ca.go.ke  on or before the close of day on 15th December 2023.

The Communications Authority of Kenya (CA) is the regulatory authority for the ICT industry in Kenya, with responsibilities in telecommunications, cybersecurity, e-commerce, broadcasting and postal/courier services. CA is also responsible for managing the country’s numbering and frequency spectrum resources, administering the Universal Service Fund (USF) as well as protecting the interests of users of ICT.

The Authority is charged with protecting consumers of Postal and Courier services and facilitating the development and implementation of appropriate operational and technical measures to safeguard consumers. This responsibility is pursuant to Section 47 of the Kenya Information and Communications Act, 1998.

With the security of mail being a challenge for players in the postal sub-sector, there is increased demand and adoption of postal and courier services and last-mile delivery, it is therefore critical that the service providers take precautions on how they handle mail.  In view of this, the Authority developed draft Guidelines that are aimed at enhancing mail security which will boost consumer confidence in the postal sub-sector. 

Consequently, the draft Guidelines have been subjected to the public consultation process and the comments received have been considered in the final document.

In view of the draft Guidelines being applicable to all postal and courier licensees in Kenya, their franchisees, agents or sub-contractors involved in the conveyance, receipt, collection, sortation, delivery or handling of postal articles, the Authority wishes to invite postal/courier licensees to a virtual validation forum. The forum will validate the draft Guidelines for the next processes.

The Authority is carrying out a Competition Study in The Broadcasting Sub-Sector and Signal Distribution Pricing Framework in Kenya, which commenced on 3rd April 2023, through M/S Tilil Technologies and Acacia Economics.

The overall objective of the study was to assess competition in the broadcasting sub-sector and review the pricing and access framework applicable to all broadcasters (content providers), with a view to enhancing fair and healthy competition to maximise the efficiency of the market.

Further to the stakeholder validation workshop on the interim report, which took place on 23rd November 2023, we are happy to share the report and the dissemination workshop presentation.

The Authority hereby invites your comments on the interim report prior to the conclusion of the study. Your feedback will enrich the final report to be released at a later date.

In furtherance of its responsibility to develop a responsive legal, regulatory and licensing regime, and in its effort to effectively manage the frequency spectrum resource, the Authority is in the process of reviewing its existing frequency spectrum pricing framework. To this end, the Authority has contracted Ms. Advatech Group and LS Telcom to jointly carry out a Frequency Spectrum Pricing Study.

The two (2) consultants intend to carry out stakeholder consultations on the existing frequency spectrum pricing framework and will contact stakeholders on behalf of the Authority.

The consultants will help the Authority to gather data and key insights regarding the current state of spectrum pricing in Kenya, and its alignment with broader market dynamics, policies and regulations.

The stakeholder consultation process will be carried out between 13th November 2023 to 27th November 2023. The Authority therefore calls on stakeholders to actively patriciate in this process and provide feedback during the consultation period.

The comments received will inform the review of the frequency spectrum pricing framework.

The CA is also responsible for managing the country’s numbering and frequency spectrum resources, administering the Universal Service Fund (USF) as well as protecting the interests of users of ICT services.

The Authority is finalizing the development of a framework for the introduction of digital sound broadcasting in Kenya. This initiative is intended to ensure efficient utilization of the scarce broadcasting spectrum and an effort to satisfy the growing demand for radio broadcasting services that have outstripped the existing FM radio frequencies.

As part of the said framework, the Authority has developed draft minimum technical specifications for digital radio receivers that shall be used for the reception of digital radio broadcasting services.

The Authority, therefore, invites stakeholders and the public to provide inputs/comments on the technical specifications with justification of the same.

The said technical specification for DAB+ receivers is available on the Authority’s website at https://www.ca.go.ke/open-consultations.

The Authority will appreciate your comments no later than 30th June 2023.

The Communications Authority of Kenya (CA) is the regulatory authority for the ICT industry in Kenya, with responsibilities in telecommunications, cyber security, e-commerce, broadcasting and postal/courier services. The CA is also responsible for managing the country’s numbering and frequency spectrum resources, administering the Universal Service Fund as well as safeguarding the interests of users of ICT services.

The Authority regularly establishes and reviews new sector regulations, guidelines and policies. This is informed by the rapidly changing ICT sector and the emerging technologies that present tremendous opportunities and regulatory challenges that may require a new approach.

It is against this backdrop that the Authority is developing this regulatory sandbox with the aim of nurturing and supporting innovation by exploring the application of innovative regulatory solutions. This effectively shapes the future of the information and communications landscape by facilitating innovation and creating certainty, which will translate to more opportunities for open collaboration, innovation, economic growth and better lives for citizens.

PUBLIC CONSULTATION ON INDUSTRY GUIDELINES FOR CHILD ONLINE PROTECTION AND SAFETY IN KENYA

The Communications Authority of Kenya (CA) is the regulatory authority for the ICT industry in Kenya with responsibilities in telecommunications, cybersecurity, e-commerce, broadcasting and postal/courier services. CA is also responsible for managing the country’s numbering and frequency spectrum resources, administering the Universal Service Fund (USF) as well as protecting interests of users of ICT.

Pursuant to Section 23 of the Kenya Information and Communications Act 1998 and Regulation 4,9 and 21 of the Kenya Information and Communications (Consumer Protection), Regulations 2010, the Authority is charged with protecting consumer of communication services and facilitating the development and implementation of appropriate operational and technical measures to safeguard consumers. These safeguards include mechanisms to ensure that children, being vulnerable consumers, have a safer internet experience in Kenya.

In this regard, the Authority has developed “Industry guidelines for child online protection and safety in Kenya”.  The Authority wishes to submit the above guidelines for public consultation.

Stakeholders, including the general public and all interested parties, are invited to review the proposed industry guidelines for child online protection and safety in Kenya and provide any suggestion(s) with justification(s), views and inputs in enhancing its implementation.

Stakeholders, interested parties and the public have until 20th May 2022 to submit their inputs and comments which will inform any changes to the final industry guidelines for child online protection and safety in Kenya.

The Act empowers the Authority to prescribe, periodically review and ensure compliance with the Programming Code. In addition, Chapter V of the Kenya Information and Communications Broadcasting Regulations, 2009 (as amended) outlines the broadcasting content standards that are applicable to ALL broadcasting licensees.

In furtherance of its responsibility of setting standards for the time and manner of programmes to be broadcast by ALL broadcasting licensees as provided for under Section 46H (1) of Kenya Information and Communications Act, 1998 (as amended), the Authority has proposed revisions to the Programming Code.

The objective of this consultation process is to give stakeholders and the public an opportunity to comment on the proposed revisions that broadcasting licensees will be required to implement in order to enhance the provision of responsible programming catering for all sections of the Kenyan community.

The proposed review is also meant to enhance consumer protection as well as promote innovation and public interest in broadcasting services. The revised Programming Code is available on the Authority’s website at https://www.ca.go.ke/open-consultations.

Stakeholders including members of the public, consumer organizations, agencies dealing with media and broadcast issues, licensees and incorporated bodies are invited review and submit specific inputs and views on the proposed requirements aimed at promoting responsible and responsive broadcasting in Kenya.

Written comments on specific proposed requirements and any other requirement should be submitted in the prescribed format below and sent to the address indicated below or via email address ProgCodeReview2023@ca.go.ke on or before the close of day on 20th August 2023.

The comments received will inform the final version of the Programming Code for implementation by the relevant broadcasting service licensees as part of enforceable license conditions.
