The Kenya Communications Act 1998 vests the Communications Authority of Kenya with adjudicative powers in the discharge of its statutory mandate of licensing and regulating telecommunications, radiocommunication and postal services within the country. The Authority has on a number of occasions exercised these powers in a bid to ensure provision of communication services and effective competition in the provision of such services.

Below are rulings and determinations made since the Authority’s inception.

Determination No.2 of 2016 on Terrestrial Broadcast Signal Distribution (BSD) Pricing and Access Framework

Wednesday, 9th December 2016
This determination revised the charges for terrestrial digital broadcast signal distribution services, to be applied by all signal distributors in Kenya from the year 2016 to 2018. The determination also provides a framework for infrastructure sharing and a standard Reference Access Offer (RAO) template.

 

Determination No. 1 of 2013 on Cost-Based Terrestrial Digital Broadcasting Signal Distribution Tariff and Addendum No. 1 to the Determination

This determination provided for terrestrial digital broadcast signal distribution charges, to be applied by all signal distributors in Kenya from 16th December 2013.

Determination No. 2 of 2010 on Pure Long Run Incremental Cost (LRIC) Based Interconnection Rate Regime

Monday, 16th August 2010
This determination provides for a glide path on interconnection rates for the period 1st July 2010 to 1st July 2013, for mobile and fixed telecommunications network operators in Kenya. It also provides a framework for infrastructure sharing and co-location.
